6. Obligation to Provide Data

Various types of personal data are necessary for establishing, executing, and terminating contractual relationships, as well as fulfilling related contractual and legal obligations. The same applies to the use of our website and the various functions it offers.

7. Recipients of the data / categories of recipients
Within our company, we ensure that only those persons receive your data who need it to fulfill their contractual and legal obligations.
In certain cases, service providers support us in operating the website. The necessary data protection contracts have been concluded with all service providers (IT service providers, advertising agencies).

8. Storage duration of the data
We store your data for as long as it is required for the respective processing purpose. Please note that numerous retention periods require that data (must) continue to be stored. This applies in particular to retention obligations under commercial or tax law (e.g. German Commercial Code, German Fiscal Code, etc.). If there are no further retention obligations, the data is routinely deleted once the purpose has been achieved.

In addition, we may retain data if you have given us your permission to do so or if legal disputes arise and we use evidence within the framework of statutory limitation periods, which can be up to thirty years; the regular limitation period is three years.

9. Transfer to third countries / intention to transfer to third countries
Data will only be transferred to third countries (outside the European Union or the European Economic Area) if this is necessary for the performance of the contractual relationship, is required by law or if you have given us your consent to do so.

We do not (currently) transfer your personal data to any service providers or group companies outside the European Economic Area.

The following provides information about the collection of personal data when using our website. Personal data includes, for example, your name, address, email address, and user behavior.

a) Collection of Personal Data When Visiting Our Website (Art. 6(1)(f) GDPR):
If you use our website for informational purposes only—i.e., without registering or providing us with other information—we only collect the personal data that your browser transmits to our server. If you wish to view our website, we collect the following data, which is necessary for us to display the website and ensure stability and security:

- IP address
- Date and time of request
- Time zone difference from Greenwich Mean Time (GMT)
- Content of the request (specific page)
- Access status/HTTP status code
- Amount of data transferred
- Referring website
- Browser
- Operating system and its interface
- Language and version of the browser software.

For security reasons (especially to prevent attacks on our web server), this data is stored under Art. 6(1)(f) GDPR. After a maximum of 7 days, the IP address is anonymized so that it can no longer be linked to the user.

b) Cookies (Art. 6(1)(a), (f) GDPR, § 25(1), (2) TDDDG)

Our website uses cookies to make our services more user-friendly, effective, and secure. Cookies are small text files stored on your device and saved by your browser.

Some cookies persist only for the duration of a browsing session (session cookies), while others are stored for longer periods (persistent cookies, e.g., consent settings). Persistent cookies are automatically deleted after the specified time. In addition to our own cookies, we also use third-party cookies. These are used by external providers to display content or track the pages you visit.

The following cookies are used on our website:

NameProviderFunctionDuration
omCookieConsentFirst PartyConsent (funktional)1 year

Due to our legitimate interest (Article 6(1)(f) GDPR), we use technically necessary cookies that are essential for operating the website and ensuring its functionality. Furthermore, we use cookies without your consent if their sole purpose is to store or access information stored on your device to transmit messages or if they are strictly necessary to provide a service you have expressly requested (§ 25(2) TDDDG).

With your consent, additional cookies may be used alongside the technically required ones, allowing us or third parties to analyze how our services are used. This enables us to tailor content to user needs. Additionally, cookies allow us to measure the effectiveness of certain advertisements and adjust their placement based on user interests. The legal basis for this is your explicit consent (Article 6(1)(a) GDPR, § 25(1) TDDDG).

You can revoke your consent at any time via our consent banner and change your cookie settings. Please note that changes must be made separately for each device.

If you maintain accounts with third-party providers we use and are logged in there, your data may be linked to the respective account. You can prevent such linkage by not giving or revoking your consent to the relevant cookies or by logging out of the respective third-party providers in advance.

Please also note our information in the section of each service that uses cookies.

c) Use of Google Tag Manager

This website uses the Google Tag Manager of Google Ireland Limited (Gordon House, Barrow Street, Dublin 4, Ireland). This service allows website tags to be managed via an interface. The Tag Manager is used to control various scripts that may trigger further data processing. The Google Tag Manager triggers other tags, which in turn may collect data. However, Google Tag Manager does not access this data. If deactivation has been carried out at domain or cookie level, it remains in place for all tracking tags, insofar as these are implemented with the Google Tag Manager.

The legal basis for the use of Google Tag Manager is your express consent, Art. 6 para. 1 sentence 1 lit. a GDPR and - insofar as the Tag Manager accesses information in the end device - Section 25 para. 1 TDDDG. Details on the data can be found in the respective sections on the tools controlled via the Tag Manager. These can be processed upstream by the Tag Manager using a tag and then transferred to other tools (e.g. Analytics, Ads).

As part of the use of Google Tag Manager, connection data (e.g. your IP address) is collected and may be processed outside the European Union and the European Economic Area, where there is no adequate level of data protection. We transfer the data to the USA on the basis of your express consent in accordance with Art. 49 para. 1 sentence 1 lit. a GDPR. In the case of Google, there is a risk that your data may be processed by US authorities for control and monitoring purposes without you having any legal recourse. The assertion of data subject rights may also be restricted. However, we take the possible measures required under data protection law in accordance with Art. 44 et seq. GDPR to establish the level of data protection in the third country.

You can revoke your consent at any time with effect for the future. To do so, simply call up our consent banner and deselect the corresponding consent. Please note that the change in the consent banner settings must be made individually for each end device.

More information about Google Tag Manager can be found at the following link: marketingplatform.google.com/about/analytics/tag-manager/use-policy/.
